Terms and Conditions

PLEASE READ THE FOLLOWING BOOKING CONDITIONS CAREFULLY WHICH OUTLINE OUR OBLIGATIONS TO YOU, AND YOUR RESPONSIBILITIES TO US.

These terms and conditions are the entire agreement between you and Nurture Her Pty Ltd ("Nurture Her").

These terms and conditions are governed by New South Wales, Australia law and the parties submit to the non-exclusive jurisdiction of the courts of New South Wales, Australia in respect of any dispute or proceeding.

PASSPORT AND VISAS

It is your responsibility to ensure you have a valid passport (including sufficient minimum 6 months validity from return date) and any applicable visa. Should you not have sufficient validity on your passport, you may be refused travel with no refund applicable. All extra incurred travel expenses will be the responsibility of the traveller.

HOW TO BOOK

Contact us directly or book via our online booking system. The agreed deposit amount of $750 per person is required to secure your reservation together with a completed online traveller information form. Upon receipt of your booking, a confirmation invoice will be issued with a deposit payable within 7 days. By paying a deposit you agree that you have read, understood and will be bound by these terms & conditions. The balance of the fare must be received by Nurture Her Pty Ltd prior to the 30th June 2020. If the balance of monies is not paid by this date, cancellation may occur with all monies paid forfeited.

CANCELLATIONS

If you cancel your reservation, the following charges will apply: 

Deposits paid are fully refundable up until the 31st January 2020, after this time deposits are non-refundable 7 days after payment. 

50% cancellation fee will apply to all bookings cancelled between 120-45 days prior to departure. 

100% cancellation fee will apply to all bookings cancelled within 45 days of departure. 

Depending on your reason for cancelling and provided your reasons fall within the terms of your travel insurance policy, subject to these terms and conditions you may be able to have these charges refunded. Consult your insurer for further details.

CANCELLATIONS (ACTIVITIES)

All additional add on products sold by Nurture Her and/or its 3rd party suppliers are non-refundable/non-changeable/non-exchangeable. These items/activities may be amended/changed within 7 days of purchasing the item/activity however this is at the sole discretion of Nurture Her and/or 3rd party suppliers. Additional fees may be charged should a change be permitted. These amendments/changes are subject to availability. 

Depending on your reason for cancelling and provided your reasons fall within the terms of your travel insurance policy, subject to these terms and conditions you may be entitled to a refund. Please consult your insurer for further details.

CHANGE/AMENDMENT OF BOOKINGS

After final payment or 30th June (whichever comes first), changes will incur an administrative fee of $100 (or local currency equivalent) per person per change, plus any additional fees charged by 3rd party operators.

Changes/Amendments within 48 hours of departure will incur a fee of $200.00 plus any additional fees passed on by 3rd party operators.

Such changes are subject to availability and only upon full agreement by Nurture Her Pty Limited at our sole discretion. If your requested change is not available normal cancellation policy applies.

PRICES

The prices stated are valid from November 2019 to October 2020. Fares are “per person” & quoted in the stipulated currency throughout the brochure and website. They are inclusive of GST where applicable. Fares must be paid in full prior to departure. Nurture Her reserves the right to amend prices at any time. Air taxes and charges are subject to change; therefore the package price may vary between the time of deposit and time of final payment.

WHAT’S NOT INCLUDED IN OUR PRICES

Personally incurred expenses such as souvenirs, telephone, email, laundry charges, optional activities and items of a personal nature (e.g. drinks). 
Meals or accommodation whilst travelling to/from your home port. 
Any travel cost incurred to/from your home port. 
Any charges levied by resorts/vessels/coaches for use of their facilities. 
Travel Insurance. 
Travel Visa’s (where required)

WHAT SHOULD YOU BRING?

We recommend the following: toiletries & items of a personal nature, hat, sunscreen, camera, insect repellent, adequate clothing.

LUGGAGE/BAGGAGE

You are requested to limit your luggage to one small/medium soft bag or suitcase weighing no more than 23kgs and a small day pack (this limit may vary, please refer to your final documents for further information). Any additional charges for luggage will be the responsibility of the traveller. Nurture Her Pty Ltd will not be held responsible for any loss or theft of baggage or belongings. You should ensure you have the appropriate travel insurance.

INSURANCE

It is a condition of purchasing a Nurture Her Pty Limited package that you have adequate travel insurance for you and all members of your travelling party. You should take out travel insurance at the time your booking is confirmed.

Whilst Nurture Her exercises utmost care, in the unlikely event of an emergency, staff may use their sole discretion to call for medevac, emergency transfer or other such matters if they feel the situation warrants it. In such instance Nurture Her reserves the right to claim a refund of such monies from you in the first instance and your insurer if required. Ask us for travel insurance details at the time of booking if you need further information.

NURTURE HER STAFF

You agree to accept the authority of Nurture Her staff and comply with their decisions. In the event a staff member requires a passenger to leave a trip, no refund will be given. That passenger is also responsible for their return transportation costs and will have no claim against Nurture Her. Please refer to the code of conduct.

BROCHURE/WEBSITE/PHOTOGRAPHY

Nurture Her has made every endeavour with the production of its brochure and website (www.nurtureher.com) to ensure that the information is correct at the time the brochure was printed and the website information uploaded. However, prices and services set out in our brochure and on our website are subject to change or withdrawal without notice. You agree that any photograph or image taken of you during your trip with Nurture Her may be used by Nurture Her and Nurture Group for promotional purposes or in our brochure or on our website without any further consent or payment.

CHANGES IN ITINERARY

Nurture Her reserves the right to make changes to an itinerary if circumstances beyond our control make it necessary, including weather and cultural conditions.

PRE AND POST TOUR TRAVEL AND ACCOMMODATION

Nurture Her is not responsible for your travel arrangements and costs incurred in getting to the point of commencement of the holiday, or from the point of conclusion of the holiday (unless stated otherwise in the booking inclusions). All bookings with these carriers, hoteliers or other service providers are subject to their terms and conditions and limitations of liability imposed.

HEALTH, FITNESS & MEDICAL

You should be of reasonable health and fitness and carry all required medication. You must inform Nurture Her of any pre-existing medical conditions, including mental illness prior to travel. Nurture Her will keep this information confidential. We may request a doctor’s certificate certifying fitness to travel. In certain circumstances, Nurture Her may require that a carer travels with you if you have special needs or a disability. Nurture Her reserves the right to refuse to carry passengers who we believe may not be able to safely undertake one of our holidays. In the event, the resort/vessel/vehicle carrier refuse travel due to pre-existing medical conditions that have not been notified, Nurture Her will not be liable and no refund applicable.

MATTERS OF DISPUTE

In the unlikely event of any dissatisfaction with the accommodation or any other service provided by Nurture Her, you must report it immediately to Nurture Her or resort/vessel/vehicle staff so action can be taken to remedy the problem. Failure to notify Nurture Her or resort/vessel/vehicle staff of any problem immediately may result in your ability to claim compensation from them being extinguished or reduced. Any complaint made to us after the holiday should be made in writing within 28 days of holiday completion. Should the complaint not be made in writing within this time, Nurture Her may refuse to investigate or offer any form of compensation. This will be at the sole discretion of Nurture Her and our 3rd party suppliers/operators.

CODE OF CONDUCT

The success and enjoyment of your holiday depend on you and others behaving in an appropriate and responsible manner. It is a condition that your conduct is compatible with the well-being and general enjoyment of others on your holiday. You agree to accept the authority of Nurture Her staff and resort staff and comply with their authority and their directions. Nurture Her has a zero-tolerance to illegal drug use and possession, threatening or abusive behaviour, both physical and verbal, and property vandalism. If, in the absolute opinion of Nurture Her staff your behaviour breaches this code of conduct then Nurture Her will remove you from the trip. If this occurs you will be responsible for your own return transport costs and you will not be entitled to any refund for the unused portion of your holiday. You also agree that you will have no claim against Nurture Her or the resort.

LIMITATIONS OF LIABILITY

The responsibility of Nurture Her and/or their agents is limited. Nurture Her acts as a tour operating company and is not a carrier, hoteliers, or provider of other services such as sightseeing tours and adventure activities. All bookings are subject to the terms and conditions and limitations of liability imposed by those carriers, hoteliers and service providers. Those terms and conditions may limit or exclude liability for death, personal injury, delay and loss or damage of baggage. Nurture Her will not be liable for any death, personal injury delay, damage, loss, accident or additional expenses or inconvenience which may be occasioned either by reason of any defect in any resort/ vessel/vehicle, or caused through the default or negligence of any company or person engaged in conveying you or in carrying out the arrangements in connection with your holiday. 

Force Majeure: Nurture Her will not be liable to you in the event your trip is disrupted or terminated by reason of an unforeseeable event such as cyclone or other adverse weather condition, military coup, political action or civil war or acts of terrorism. Your trip may include activities such as swimming, snorkelling, diving or parasailing. You accept that these activities and others of a similar nature may involve varying degrees of risk and you take part at your own risk. You accept that Nurture Her is not responsible for any personal injury or death sustained in these activities or others undertaken whilst on your trip. Nothing in these terms and conditions shall be read as excluding, restricting or modifying your rights given to you under legislation in relation to the supply of goods and services including the Consumer Guarantees Act. Passengers who purchase an optional service or product do so in direct contact with the provider and rely solely on their own judgment for participation. By completing the booking you warrant that the information contained in the booking is correct.

PRIVACY

Nurture Her stores information about you and your booking so that we can notify you of our holidays, special offers and for the purposes of obtaining your feedback. As an individual (i.e. a natural person), you have rights under the Privacy Act 1993 to access and request the correction of any personal information that we hold about you. As an individual, your name, company, position and email address will be visible on our Nurture Her App and on a networking attendee list viewable to all other attendees. If you do not want to receive information from Nurture Her or to have your details visible on our app and/or attendee networking list please contact us on [email protected]

ACCURACY

Nurture Her has taken all reasonable care to ensure the accuracy of the information on the website and other published material however prices and services offered are subject to change.
